Terms and conditions
Note: This English version is for convenience; the German version (AGB) is legally binding.
Last updated: 13 October 2026
1. Scope
- These terms and conditions apply to all contracts between Internet am Dornbusch, owner Sajjad Hanifa, Eschersheimer Landstraße 297, 60320 Frankfurt am Main, Germany (the "Provider") and its customers for the use of the software-as-a-service application My Store Locator (the "Service").
- The Service is offered exclusively to businesses within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law. Consumers within the meaning of Section 13 BGB may not use the Service. By registering, the customer confirms that it is acting as a business.
- Deviating, conflicting or supplementary terms of the customer do not become part of the contract unless the Provider expressly agrees to them in text form.
2. Conclusion of contract
- The presentation of the Service on the website does not constitute a binding offer.
- The contract for the free plan or the trial is concluded when registration in the application is completed. By registering, the customer makes an offer, which the Provider accepts by activating the account.
- The customer books paid plans in the application under "Plan & billing" via the checkout of the payment service provider Stripe (Section 5) or on the basis of an individual quote (in particular Enterprise). The contract for the paid plan is concluded when the checkout has been completed successfully, or, for individual quotes, when the Provider confirms in text form.
- The customer must provide truthful and complete information when registering and keep it up to date.
3. Provider's services
- The Provider makes the Service available to the customer over the internet. The Service allows the customer to manage location data and embed it as a location map (store locator) on the customer's websites.
- The specific scope of services is set out in the service description and price list of the respective plan valid at the time of booking, in particular regarding the number of locations, maps, users and map views per month.
- Features labelled "coming soon" ("in Vorbereitung") on the website or in the application are not part of the agreed scope of services until they are generally released.
- The Provider may develop and adapt the Service, provided that the contractually agreed scope of services is not materially restricted and the change is reasonable for the customer.
- The Provider may use subcontractors to provide the Service, in particular for hosting. Section 9 applies to the processing of personal data.
4. Free plan and trial
- The Provider offers a free plan with a limited scope of services. There is no entitlement to the free plan being provided permanently in unchanged form. The Provider will announce material restrictions in text form with reasonable notice.
- New accounts receive a 14-day trial with the features of the Pro plan. The trial is free of charge. When the trial ends, the account is automatically switched to the free plan unless the customer has booked a paid plan beforehand. The trial is not automatically converted into a paid plan.
- If the customer exceeds the limits of its plan, the Provider may restrict use to the scope of the plan after notifying the customer.
5. Prices and payment
- The prices in the price list valid at the time of booking apply. All prices are exclusive of statutory VAT.
- Fees are payable in advance, monthly or yearly depending on the billing period chosen, and are collected at the start of each billing period.
- Payments are processed by the payment service provider Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland ("Stripe"). The payment methods shown in the checkout are available (for example card, SEPA direct debit or PayPal). The customer authorises the Provider to collect the amounts due via Stripe from the payment method on file. Stripe's terms additionally apply to the payment process.
- Invoices are provided electronically (in the customer portal and by e-mail).
- If the customer is in default of payment, the Provider may block access after prior notice in text form and setting a reasonable deadline. The obligation to pay remains unaffected.
- The Provider may adjust prices with effect from the next billing period. It will announce price changes in text form at least six weeks before they take effect. In this case the customer may terminate as of the date the change takes effect; the Provider will point out this right in the announcement.
6. Term and termination
- The free plan runs for an indefinite period and can be terminated by either party at any time. The customer can close its account in the application.
- Paid plans billed monthly have a term of one month and renew for a further month unless terminated by the end of the current billing period.
- Paid plans billed yearly have a term of one year and renew for a further year unless terminated by the end of the current billing period.
- The customer cancels a paid plan via the customer portal in the application ("Plan & billing") or in text form (for example by e-mail to info@my-store-locator.com). Cancellation takes effect at the end of the current billing period; until then the booked plan remains available, after that the account is switched to the free plan. Fees already paid for the current billing period are not refunded pro rata, except in the case of a justified termination for good cause by the customer.
- The right to terminate for good cause remains unaffected.
- The customer can export its data at any time using the application's export function (CSV/JSON). The Provider deletes the customer's data 30 days after the contract ends, unless statutory retention obligations apply. Within these 30 days the Provider provides the customer with an export of its data on request.
7. Availability
- The Provider endeavours to keep the Service available with as few interruptions as possible. A specific level of availability is only owed if expressly agreed in an individual contract (service level agreement, in particular on the Enterprise plan).
- The Provider carries out maintenance at times of low usage where possible.
- The Provider is not responsible for disruptions caused by circumstances beyond its control, in particular internet outages, force majeure and disruptions of third-party services the customer embeds itself.
8. Customer obligations
- The customer is responsible for the content it enters into the Service (e.g. location data, images, texts). It ensures that it holds the necessary rights and that the content does not infringe applicable law or third-party rights.
- The customer is responsible for ensuring that embedding the Service on its website is lawful. This includes in particular an accurate privacy policy and, where required, obtaining the consent of website visitors. The Service offers a consent mode for this (load the map only after a click).
- The customer keeps its login details secret and protects them from access by third parties. It grants team members access only to the extent necessary and is responsible for their actions in the account.
- The customer refrains from actions that impair the functioning or security of the Service, in particular circumventing technical restrictions, automated mass queries outside the intended interfaces and introducing malicious code.
- If the customer breaches these obligations, the Provider may block the content concerned or temporarily restrict access. The Provider takes the customer's legitimate interests into account and informs the customer without delay.
- The customer indemnifies the Provider against third-party claims based on a culpable breach of these obligations, including reasonable legal defence costs.
9. Data protection and processing on behalf
- Where the Provider processes personal data on behalf of the customer as part of the Service, the parties conclude a data processing agreement under Art. 28 GDPR. The customer can download it in the application under "Plan & billing". More information: DPA.
- Otherwise, the privacy policy applies.
10. Liability
- The Provider is liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given.
- In cases of slight negligence, the Provider is only liable for breach of an essential contractual obligation – one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance the customer may regularly rely (cardinal obligation). In this case liability is limited to the foreseeable damage typical for the contract at the time it was concluded.
- Strict liability of the Provider for defects already existing at the time the contract was concluded (Section 536a(1), first alternative, BGB) is excluded.
- The Provider is liable for loss of data only to the extent that would have arisen had the customer backed up its data properly, in particular by regularly using the export function.
- On the free plan and during the free trial, the Provider is liable – except in the cases set out in paragraph 1 – only for intent and gross negligence.
- The above limitations also apply in favour of the Provider's legal representatives, employees and vicarious agents.
11. Changes to these terms
- The Provider may amend these terms with effect for the future where there is a valid reason, such as a change in the law or further development of the Service, and the balance between performance and consideration is not materially shifted to the customer's disadvantage.
- The Provider will notify changes in text form at least six weeks before they take effect. If the customer does not object within this period, the changes are deemed accepted. The Provider will point out the right to object and the consequences of not objecting in the notification. If the customer objects, either party may terminate the contract as of the date the change takes effect.
12. Final provisions
- The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods.
- If the customer is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Frankfurt am Main, Germany. The Provider may also bring an action at the customer's general place of jurisdiction.
- Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provision replaces the invalid provision.
- Amendments and additions to the contract must be made in text form.
